1. Terms of Sale


    It is specified that products labeled "For professional use only" or "Professional use" are not intended for the end consumer and must be used with the assistance of a qualified person. Nailfor Srl - nailfor and nailforbusiness disclaims any responsibility in case of transfer or improper use of the same.


    1. General Provisions These general terms and conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products") purchased through the website https://www.nailfor.it https://www.nailfor.com https://www.nailforbusiness.it https://www.nailforbusiness.com (hereinafter, "Site"). The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or "Customer"), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial, or professional activity. The language available for concluding the contract is Italian. The Customer is required to carefully read the General Conditions made available to him/her on the Site, in order to allow their storage and reproduction by the Customer pursuant to art. 12 of Legislative Decree 9 April 2003, no. 70. Contracts concluded with nailfor.it (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 ("Consumer Code") and Legislative Decree 9 April 2003, no. 70 (hereinafter, "E-commerce Decree").


    2. Seller Identification The seller is NAILFOR SRL, Legal Address: Via Giacinto Andrea Longhin 121, 35129 PADOVA, VAT number: 04966040281 (hereinafter "nailfor.com").


    3. Product Information Information about the Products "www.nailfor.com" available for distance selling through the Site, along with their product codes, is available on the Site. The aforementioned information is provided in accordance with articles 52 and 53 of the Consumer Code.


    4. Price: www.nailfor.com prices of products are inclusive of all taxes and duties excluding delivery charges. All prices are expressed in Euro. On https://www.nailforbusiness.com prices are excluding VAT.


    5. Order of Products The essential characteristics and prices of the Products are stated in the offer for each Product. To purchase the Products, the Customer must complete and submit to nailfor.com the order form in electronic format, following the instructions on the Site. The Customer must place the Product in the "cart" and, after having read the General Conditions, with particular reference to the contribution for delivery charges and the exercise of the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the "submit order" option. Before submitting their purchase order, the Customer will have the opportunity to correct any errors in data entry by following the appropriate modification procedure contained on the Site. In particular, the Customer has the option to modify the quantity of Products they intend to purchase, adding or removing one or more Products from the "cart". By submitting the order, the Customer acknowledges and declares to have read all the indications provided during the purchase procedure and to fully accept the General Conditions. The Customer will have the opportunity to view and track the status of their order through the "Orders" area of their account. nailfor.com reserves the right to evaluate the acceptance of orders received. nailfor.com will communicate to the Customer any inability to accept the orders received within 5 days from the following day on which the Customer has transmitted the order to nailfor.com and will refund the sums already paid by the Customer for the supply.


    6. Payment Methods The Customer can pay for the price of the Products and the related delivery charges by credit card through the PAYPAL website, by bank transfer, or cash on delivery (cash on delivery orders are not accepted for amounts exceeding €1000). nailfor.com accepts payments made with the following credit cards: Visa, MasterCard. The transaction will be charged to the Customer's credit card only after a) the credit card details have been verified, and b) authorization to charge has been received from the credit card company used by the Customer. nailfor.com also accepts payments made by Bank Transfer. The transfer must be made payable to nailfor srl and the order number must be stated as the reason for payment. The transfer must be made within 5 working days from the order; after this period, the unpaid order will be considered invalid and canceled. The order number must be indicated in the transfer reason. Any bank charges will be borne by the Customer. In the event that, for any reason, the debit of the amounts due from the Customer proves impossible, the sales process will be automatically canceled, and the sale automatically canceled. nailfor.com also accepts payment made by courier upon delivery ("Cash on Delivery"). For this method, a surcharge of €3 will be applied; in this case, the Customer must deliver to the courier in charge of delivering the goods the amount of the order in cash. If the package is refused by the Customer, the storage costs and the return of the goods will be at the Customer's expense.


    7. Order Receipt Confirmation In accordance with Article 53 of the Consumer Code, the Customer receives, at the time of contract execution, by email, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal - with indication of the times and methods for returning the goods - the geographical address to submit any complaints, and information on assistance services and existing commercial warranties.


    8. Ineffectiveness of the Order No contract shall be deemed concluded between nailfor.com and the Customer if nailfor.com has reasonable grounds to believe that the Customer does not operate on the basis of a genuine and real interest in purchasing the ordered products, or exercises the right of withdrawal recognized by article 12 below in an abusive manner. In such cases, the order submitted by the Customer shall be deemed devoid of any effectiveness. nailfor.com will send the Customer, by email, a communication attesting to the non-conclusion of the Contract, also ensuring the cancellation of any charges and/or expenses incurred by the Customer.


    9. Transportation and Delivery The Products purchased on the Site will be delivered to the address indicated by the Customer. The Customer may, in any case, request delivery of the products to a natural person of their choice, whose residence or domicile is within the Italian territory. At the time of delivery, the signature of an adult over 18 years of age will be required. Deliveries to postal boxes will not be made. For each order placed on the Site, nailfor.com issues an invoice for the goods shipped, sending it by email or together with the order, pursuant to Legislative Decree 445/2000 and Legislative Decree 52/2004. The information provided by the Customer at the time of the order will be used for invoicing. No changes to the invoice will be possible after its issuance. Delivery charges are borne by the Customer and are clearly indicated on the Site and in the order form. The shipping cost in Italy for orders under €39.00 is €4.90, while it may vary within the EU. Any customs duties are borne by the Customer. All purchases will be delivered by GLS Italy Spa or Nexive, the Customer can indicate a preference at


     the time of purchase among those proposed by nailfor.com (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. nailfor.com is not responsible for unforeseeable delays. nailfor.com or the designated express courier will send the Customer an email confirmation once the Products have been shipped, specifying the tracking number of the shipment through which the status of the shipment can be viewed, upon insertion on the Courier's website. In any case, except in cases of force majeure or fortuitous events, in accordance with the Consumer Code, the Products will be delivered within a maximum period of 3 (three) days from the day following the day on which the Customer has transmitted the order to nailfor.com, unless nailfor.com communicates - within the same period, by email - the impossibility of delivering the ordered goods due to the subsequent unavailability, even temporary, of the Products. In case of such communication, nailfor.com will refund the sums already paid by the Customer for the supply. In the event that, following nailfor.com's communication of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the same will be refunded as soon as possible, and in any case no later than 15 (fifteen) days from the day following the day on which the Customer has transmitted the order to nailfor.com. For the delivery of the goods, the presence of the Customer or a person appointed by them at the address of the recipient indicated in the order is necessary. At the time of delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or not altered. Any damage to the package and/or the Products or the failure to correspond to the number of packages must be immediately contested by means of a written control reservation on the Courier's delivery proof. Once the Courier's document has been signed, the Customer cannot make any complaints regarding the external characteristics of the delivered package.


    10. Right of Withdrawal nailfor.com wants to ensure complete Customer satisfaction. In accordance with article 64 of the Consumer Code, the Customer has the right to withdraw from the contract, without specifying the reason, by returning the Products purchased through the Site within 10 (ten) working days from the date of receipt of the Products. To exercise the right of withdrawal, the Customer must send the following address: info@nailfor.com a communication containing: a) the expression of the will to avail themselves of the right of withdrawal pursuant to art. 64 of the Consumer Code; b) the indication of the Products for which the Customer intends to exercise the right of withdrawal; c) the progressive order number issued at the time of purchase; d) the details of the Customer's bank account, only if the Customer has made payment by bank transfer. This communication can also be sent, within the aforementioned period of 10 (ten) days, by email, telegram, and fax. In case of exercise of the right of withdrawal, nailfor.com will fully refund the price of the Products provided that they are returned by the Customer in normal condition and only if the return instructions above are correctly followed. nailfor.com reserves the right to refuse the return of those Products that do not comply with these requirements. Refunds will be made using the same payment method used for the purchase or by bank transfer. The delivery costs for the return of the Products are borne by the Customer; any expenses incurred by the Customer for the return will not be refundable. Each delivery will contain easy instructions for the return of the Products. Nailfor.com undertakes to promptly refund the Customer within no more than 15 days from the date of return of the Products. nailfor.com will send an email confirmation of the refund. nailfor.com will not be liable for the refund or compensation related to Products returned but never received by nailfor.com due to loss, theft, or damage not attributable to nailfor.com. If the Customer wishes to modify or cancel the order submitted, they must promptly send an email to info@nailfor.com. Once the Product has been shipped, the order cannot be canceled or modified until the shipped goods have been returned to nailfor.com. In this case, reference is made to the return policy described above.


    11. Product Replacement nailfor.com intends to provide Customers with the opportunity to replace Products purchased through the Site. To obtain the replacement of a Product, the Customer must follow the procedure indicated below. The Customer who is not entirely satisfied must keep all documentation relating to the delivery and the Product itself in its original packaging and immediately contact nailfor.com by email at the following address: info@nailfor.com. The Product to be replaced must be returned, in normal condition, sealed, and not consumed to the following address: Via Oslavia 17/3 - Milano 20137. The processing of the new order is subject to the availability of the requested Products. For perishable materials, replacements can be made within 15 days from the purchase. The shipping costs for the return of the Product are borne by the Customer. The replacement Product will be sent to the Customer by express courier without additional shipping costs in the subsequent order made by the customer; otherwise, if the customer wishes the replacement product immediately, the shipping costs by express courier will be borne by them.


    12. Non-conformity Defects In case of non-conformity defects of Products sold by nailfor.com, the Customer must immediately contact nailfor.com at the email address info@nailfor.com. The legal guarantees provided for by articles 129, 130, and 132 of the Consumer Code apply to the sale of the Products. The Customer is entitled to the restoration, free of charge, of the conformity of the goods through repair or replacement, or to an adequate reduction of the price, or to the resolution of the contract. The Customer loses these rights if they do not report the non-conformity to Nailfor.com within two months from the date on which they discovered it. The action aimed at asserting defects not fraudulently concealed by nailfor.com prescribes, in any case, within twenty-six months from the delivery of the goods.


    13. Errors The information relating to the Products provided on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors. nailfor.com reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent and also to change or update information at any time without prior notice.


    14. Applicable Law and Competent Court These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws. For disputes arising from the interpretation, validity, and/or execution of these General Conditions, the territorial jurisdiction shall be that of the judge of the place of residence or domicile of the consumer, if located within the Italian territory.
